“I had the honor of representing Mr. Martin Peterson back in 2013. Prior to my representation of him and just before trial, Martin turned down a prosecution offer of five years of felony probation to take his chances before a jury. This offer reflected the weakness of the case, which was exclusively based on ever shifting claims of sexual crimes by a single accuser. These claims contained numerous factual contradictions made under oath that Martin felt would be seen by the jury. As a more hardened lawyer, I would observe that often times a jury will convict on sordid accusations almost as a precaution, resulting in wrongful convictions in serious cases.
Because the entire case against Martin was built on self-contradictory testimony, Martin believed that the jury would not convict. Turning down the probationary offer was a huge decision for Martin, since a conviction would result in mandatory life in prison. This roll of the dice resulted in his worst nightmare coming true - a conviction and life in prison. As I have seen too many times, innocent clients make the mistake of ‘believing in the system.” Such faith should only be reserved for God. But God works in mysterious ways, and this is when Martin and his wife Mary came into my life.
Mary worked tirelessly to show why the conviction was erroneous, and shared those thoughts with me as an appellate attorney. I became convinced of the cause, and gave it my best to assure that the direct appeal was done correctly. Unfortunately, meaningful reversals on direct appeals are very rare in our court, with only six out of one thousand cases resulting in any kind of meaningful relief for a defendant, much less exoneration. While I worked on the direct appeal, I advised Mary to begin work on Martin’s 3.850 post-conviction motion which, as Martin’s appointed public defender, I could not handle.
Against the odds, Martin’s first direct appeal resulted in a reversal and remand for reconsideration of the motion for new trial. Unfortunately, the argument for a new trial hearing did not move the trial judge. A second appeal followed, and in that second appeal the appellate court simply affirmed the trial court. Hope seemed to be lost. But all the while in the background, Mary was diligently working on Martin’s 3.850 post-conviction motion, assembling a vast array of jury research and hiring new counsel to present the motion to the judge.
When the trial court granted the hearing based on the research (and perhaps understanding the injustice in the situation), the prosecutor offered Martin a time served sentence in exchange for his plea, which allowed Martin to escape a life in prison sentence. Martin Peterson is free today because of the steadfast commitment and hard work of his wife, Mary Peterson. I am honored to have taken a small part in Martin’s case where justice was eventually received against tall odds.”
